Sunbury CC World Cup 2010 - Terms and Conditions
These terms and conditions together with the general terms and conditions that are applicable to your use of and access to Sunbury CC World Cup 2010 (together the "Terms") govern your use of the Website and set out the rules of participation in the Sunbury CC World Cup 2010 competition. By entering the Sunbury CC World Cup 2010 competition, you agree to be bound by the Terms.
1. Definitions (for the purposes of these terms):
"Application(s)" means the application to enter a team selection in the Competition;
"Promoter" means Sunbury CC, the promoter of the Competition, whose registered office is located at Exchange House, London EC2A 2NY, United Kingdom.
"Competition" means the Sunbury CC World Cup 2010 competition, taking place between June 11th and July 11th 2010;
"CTV" means Clever TV Limited, the provider of the Competition on the Promoter's behalf, whose registered office is located at 4th Floor, 36 Spital Square, London, E1 6DY.
"Judges" means the judging panel appointed by CTV;
"Assists" are awarded to (a) players who make the last pass to a goalscorer (b) players who make a significant contribution (run with ball, cross or pass) without any interruption in play, before the last pass is made, and (c) attacking players who play an active role in their side winning a penalty. Assists will be awarded at the sole discretion of the Judges.
"Manager" means the individual natural person responsible for the selection and entry of an individual team to the Competition;
"Mini League" means any league that is set up by a Manager comprising five or more valid team selections;
"Transfer Deadline" means the time by which you must enter your team or make your transfers in order to score points for your team or newly transferred players during the subsequent fixtures. This cut-off will be daily throughout the competition, at the first kick-off time. (London, UK time)
2. Eligibility:
Each Manager must ensure that his or her participation in the Competition (including the acceptance of any prize awarded) is lawful in accordance with the laws of England and of the country of which he or she is a citizen and/or resides, and/or happens to be at the time the entry is made. Neither the Promoter nor CTV shall be taken to make any representations, express or implied, as to the lawfulness of any Manager's participation, or as to any other aspect of the Competition.
Each Manager must ensure that his or her participation in the Competition (including the acceptance of any prize awarded) complies with any rules laid down by his or her employer (including any gift policy).
"How to enter" and any other instructions detailed in advertisements for the Competition on the Website or in any other publication shall form part of the terms and conditions of this Competition. By entering this Competition you agree to be legally bound by such terms and conditions. CTV employees, and anyone else connected with the administration of the Competition may enter but shall not be eligible to claim any of the prizes. All entrants to the Competition must be aged 18 or over. We reserve the right to take steps to verify your age.
3. How To Enter
There is a limit of one team per Manager. Applications to participate in the Competition can only be made via the internet.
Online Applications should be submitted via the Website. Online Applications must be submitted no later than 3pm on Friday 11th June 2010 in order to score points during the first scoring match. Thereafter, Applications received prior to the next Transfer Deadline, will be eligible for all points scored during the subsequent matches. Points will not be backdated.
There is no charge for playing the Competition and no purchase of any item or service is necessary in order to enter the Competition. The sole consideration required from you is that you agree to be bound by the Terms.
CTV and the Promoter shall not be responsible for Applications lost in transmission or received late due to high online traffic levels. We recommend that Applications and transfer requests are not left until just before the daily deadlines.
All Applications are subject to acceptance by CTV on the Promoter's behalf. CTV will confirm such acceptance to you, on behalf of , by online electronic means (the "Confirmation"). There will be no contract of any kind between you and the Competition unless and until you receive a Confirmation.
4. Team Names:
CTV and the Promoter reserve the right to refuse to accept any team names or Mini League names which have been duplicated or are felt, in CTV and the Promoter's sole discretion, to be inappropriate or offensive. Unsuitable names shall be deleted or amended and the team or Mini League shall appear under the Manager's or the Chairman's name. Team names that include website addresses shall also be deleted or amended.
5. Player Selection List:
The players included on the selection list and their values and position have been determined arbitrarily by the Judges. Player values remain constant throughout the Competition. CTV and the Promoter shall not enter into any correspondence relating to details of the selection list, nor will it accept the inclusion into a team of any player not on the selection list. New players may be introduced into the Competition by CTV as and when appropriate. Players will not be removed.
6. Player Selection:
Managers' team selections must consist of 11 players chosen from the selection list. The combined total value of your 11 player team selection must not exceed £100 million at any time throughout the Competition. The team of 11 must include 1 goalkeeper and 4 defenders plus either 3 midfielders and 3 strikers (4-3-3) or 4 midfielders and 2 strikers (4-4-2). Managers may switch between formations by making transfers - see clause 8.
A player can only be selected once at any one time - player duplication is not permitted. There is no restriction on the number of players chosen from the same national team
Managers of valid team selections will receive team confirmation by electronic mail but should be aware that some ISP's and central servers have 'firewalls' or other blocking software that may not allow distribution of game related communications. If you have not received your team confirmation, please check your junk/spam folder before taking further action.
7. Scoring Points:
Points will be awarded in Tournament matches played from June 11th until July 11th and including the final match, scheduled for July 11th, 2010. Points scored from abandoned matches (i.e. incomplete matches that will be replayed at a later date) will not count towards any scoring in the Competition.
Points will be awarded and deducted per match as follows:
For Goalkeepers:
Featured in starting XI: +2, substitute appearance: +1, clean sheet (awarded only when the team finishes the game with a clean sheet and to any player who has played 60 minutes or more of the game) +5, per goal conceded: -1, goal scored: +10, Assist: +3, sent off: -3, yellow card: -1 (two yellow cards leading to a red card will count as -3), penalty saved: +3, penalty missed: -3, penalty scored in shootout: +3.
For Defenders:
Featured in starting XI: +2, substitute appearance: +1, clean sheet (awarded only when the team finishes the game with a clean sheet and to any player who has played 60 minutes or more of the game) +4, per goal conceded: -1, goal scored: +8, Assist: +3, sent off: -3, yellow card: -1 (two yellow cards leading to a red card will count as -3), penalty saved: +3, penalty missed: -3, penalty scored in shootout: +3.
For Midfielders:
Featured in starting XI: +2, substitute appearance: +1, goal scored: +6, Assist: +3, sent off: -3, yellow card: -1 (two yellow cards leading to a red card will count as -3), penalty saved: +3, penalty missed: -3, penalty scored in shootout: +3.
For Strikers:
Featured in starting XI: +2, substitute appearance: +1, goal scored: +4, Assist: +3, sent off: -3, yellow card: -1 (two yellow cards leading to a red card will count as -3), penalty saved: +3, penalty missed: -3, penalty scored in shootout: +3.
An entry's nominated captain will score double points, both positive and negative.
Assists for goals will be awarded at the sole discretion of the Judges.
Scores will be updated daily, online on the Website.
8. Transfers
Managers may alter their teams by effecting transfers. A total of 20 transfers are available during the Competition. Managers may use as many of their 20 allocated transfers as they choose during any given week. Transfers beyond the maximum number allowed will be rejected.
Transfers may only be made by logging onto the Website. Transfer requests made online shall be acknowledged via on-screen confirmation. CTV shall not be responsible for transfer requests lost in transmission or received late due to high online traffic levels. We recommend that Applications and transfer requests are not left until just before the published deadlines.
Transfers may be submitted at any time until the last Transfer Deadline of the Tournament.
Players must be transferred before the next Transfer Deadline in order to score points during the subsequent Tournament matches. Players transferred after the Transfer Deadline will be eligible for points scored from the following Transfer Deadline. With regard to all transfers, Managers must ensure that their teams continue to meet the selection criteria (see clause 6). Points will not be backdated. Once submitted, transfer requests cannot be altered under any circumstances.
8. Captains
Managers may alter their team captain on the transfers screen. An unlimited number of captain changes are available during the Competition. Managers may use as many captain changes as they choose during any given stage.
9. Mini Leagues:
Entry into the Competition shall give Managers the opportunity to form their own private league Mini League. Any number of individual managers may participate in a Mini League, one of whom must be nominated as the chairman ("Chairman"). The overall point scores of the top five Managers in the Mini League will be totalled and divided by five to generate an average Mini League score. This score is used to determine league positions in the 'League of Mini Leagues.'
Mini Leagues can be entered via the Website. A Chairman must first register the Mini League and his/her own team. The Chairman will select a Mini League name and password which must be given (in exactly the form it appears) to all potential participants to that Mini League. The Chairman of a Mini League will be the recipient of all correspondence relating to that Mini League and shall be responsible for circulating such correspondence to participating Managers as appropriate.

Tie Break for Prizes
In the event of a tie, preference will be given to the Manager whose team has scored the most goals. If the result is still a tie, preference will be given to the Manager whose team has achieved the most assists, and thereafter the most clean sheets. If clear positions for the prize winners still do not emerge, preference will be given to the Manager whose team was registered first. The decision of the Judges regarding this tie-breaker shall be final and binding.
11. Further Rules
11.1; CTV and the Promoter reserve the right in their absolute discretion and at any time to:
- refuse to accept any Application;
- suspend or terminate a Manager's participation in the Competition, even if a Confirmation has been received by such Manager(s); or
- suspend or terminate a Manager's participation in one or more Mini-Leagues.
11.2; CTV and the Promoter may withhold a prize from a Manager if they consider in their absolute discretion that the Manager did or does not meet the eligibility criteria set out in Clause 2.
11.3; Managers agree that no liability shall attach to as a result of any action taken by it under clause 11.1 or 11.2 and no compensation shall be payable or paid to any Manager or other person in consequence of such action.
11.4; Where any decision is to be taken by the Judges under the Terms, the decision of the Judges shall be final and binding and neither the Promoter nor CTV will enter into any correspondence regarding such decisions.
12. General
Any decision of CTV and/or the Judges in all Competition-related matters shall be final.
CTV and the Promoter shall not be liable for any loss or damage whatsoever which is suffered by any person as a result of, or in connection with, or arising from the Competition, any prize, or these Terms, or the use of the same except for any liability which cannot be excluded by law.
Neither the Promoter nor any of its affiliates, directors or employees shall be liable to Managers for any of the following types of loss which Managers may suffer as a result of their entry to the Competition:
- any consequential, indirect or special losses and/or any loss of revenue, profits or anticipated savings suffered by a Manager as a result of 's negligence or breach of any of the Terms;
- any injury or damage to a Manager's or any other person's computer or mobile telephone related to or resulting from participation or downloading any materials in relation to the Competition;
- any losses caused by a technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail, traffic congestion on the internet or any combination thereof;
- any loss which a Manager may suffer as a result of or in connection with or arising out of any prize;
- any loss arising out of any electronic messages not being received.
- any loss arising out of the Manager not meeting the eligibility criteria set out in Clause 2.
- any tax which a Manager may be required to pay under the laws of any relevant jurisdiction on any prize awarded.
Nothing in these Terms shall affect the statutory rights of a consumer nor shall it exclude, restrict or limit the Promoter or CTV's liability for (a) breach of any term implied by section 12 of the Sale of Goods Act 1979; (b) death or personal injury resulting from negligence as defined in the Unfair Contract Terms Act 1977; or (c) fraud or any other matter if and to the extent that, under English law, such liability cannot be excluded, restricted, or limited.
the Promoter may, at its sole discretion and at any time, suspend or disqualify a Manager, reject any application, amend the Terms, or cancel the Competition (either in whole or for residents of a specific country) in the event of circumstances arising beyond 's control or which make consider it desirable to do so. Managers agree that no liability shall attach to as a result thereof and that the exercise of such discretion shall not result in any compensation being payable or paid to any Manager or other person.
If any of the Terms are determined to be illegal, invalid or otherwise unenforceable, then the remaining terms shall continue in full force and effect.
13. Complaints
Complaints: In the event an Entrant has a complaint about the Game or the service received in connection with the Game the procedure for complaining is as follows:
Contact the helpdesk, and every effort will be made to resolve the matter on an informal basis. Email complaints will receive a return email to confirm receipt.
If the matter has not been satisfactorily resolved then a formal complaint may be made by writing to the Games Manager, Fantasy Games HQ, PO Box 61047, London, SE1 2SJ. All written complaints will receive a response within 7 days of receipt of the complaint. Where a complaint requires further investigation, every effort will be made to complete the investigation within 14 days of receipt. After which time we will contact you with the findings, recommendations and any proposed actions.
If the issue is still not resolved, then you may refer your complaint to the Managing Director of cleverTV Limited, who run the game on behalf of the Publisher.
The final stage in the unlikely event of a still unresolved conclusion to a complaint will be referral to an independent party who will provide a balanced and objective opinion and recommendation on the matter. CTV use the services of PromoVeritas Ltd, the independent promotional verification service.
14. Jurisdiction
These terms and conditions and any non-contractual obligations arising out of or in connection with them, shall be governed by and shall be construed in accordance with the laws of England. The courts of England shall have exclusive jurisdiction to settle any claim arising out of or in connection with these terms and conditions or the legal relationships established by them.
